Garage Conversion ADU Requirements in California (2026): A Guide for Orange County Homeowners

A two-car garage already has a slab, walls and a roof, which is why converting a garage into an ADU is one of the most common ways Orange County homeowners add living space. This guide explains the California garage conversion ADU requirements that apply in 2026, what your city will still review, and what to check before you start.
Quick Answer: Garage Conversion ADU Rules at a Glance
- No new setback for the existing garage. State law does not require a setback for an existing structure converted to an ADU (Gov. Code 66314(d)(7)).
- No replacement parking. When a garage is converted to an ADU, the city cannot require you to replace those parking spaces (Gov. Code 66314(d)(11)).
- Small expansion allowed. An ADU inside an existing accessory structure may include an expansion of up to 150 square feet for ingress and egress (Gov. Code 66323(a)(1)).
- 60-day decision window. Cities must approve or deny a complete ADU permit application within 60 days (Gov. Code 66317).
- Building code still applies. Insulation, windows, egress, electrical, plumbing and the old garage door opening all have to meet current code.
Why Garage Conversions Are Popular in Orange County
Many homes in Anaheim, Garden Grove, Westminster, Fountain Valley and Santa Ana have an attached or detached two-car garage that is used mostly for storage. Converting that space can create a studio or one-bedroom unit for aging parents, adult children or a long-term tenant without building a new structure from the ground up.
California has spent several years removing barriers to ADUs, and garage conversions benefit from several of those rules. For the bigger picture, see our article What Is an ADU and Why It’s a Smart Move and our ADU and garage conversion services.

What State Law Says About Converting a Garage
Setbacks
An existing garage converted to an ADU does not need to meet new setback rules. New detached ADUs generally need only 4 feet from side and rear lot lines.
Parking
Converting a garage, carport or covered parking structure to an ADU does not trigger replacement parking for the main house.
Expansion
An ADU within an existing accessory structure may add up to 150 square feet to accommodate ingress and egress.
Fire sprinklers
An ADU is not required to have fire sprinklers if they are not required for the primary residence.
Rent, not sell
An ADU may be rented separately from the main home, but generally may not be sold separately.
Owner occupancy
State law generally does not allow cities to require owner occupancy for an ADU. Different rules apply to JADUs.
What Your City Will Still Review
State law sets the floor, but a garage conversion is still a building permit project. The city plan checker and inspector will look closely at the items below, and these are usually where the real work is.
| Item | What is usually checked |
|---|---|
| Garage door opening | Framing in the opening with a wall, window or door that meets energy and structural requirements |
| Floor | Garage slabs often slope toward the door; the floor may need leveling, moisture protection and insulation |
| Walls and ceiling | Insulation, drywall and, for attached garages, fire separation from the main house |
| Light, ventilation and egress | Windows for natural light and an emergency escape opening in sleeping rooms |
| Plumbing | Sewer connection path for a kitchen and bathroom, water heater location and venting |
| Electrical | Panel capacity, new circuits, smoke and carbon monoxide alarms |
| Energy code | Title 24 energy compliance for a newly conditioned space |
How a Garage Conversion ADU Works: Step by Step
Before You Start: A Homeowner Checklist
- Find out whether the garage was built with a permit, and whether anything inside it was added later without one.
- Look at where your sewer line and electrical panel are relative to the garage.
- Decide who the unit is for: family, a tenant, or a home office with a bathroom. It changes the layout.
- Think about where your cars and storage will go after the conversion.
- Ask your city about school district fees and any utility connection charges. State law limits some fees for ADUs created within existing space.
- Get the scope of work in writing before any construction begins.

Frequently Asked Questions
Do I need to replace my garage parking if I convert it to an ADU?
No. Under Gov. Code 66314(d)(11), when a garage, carport or covered parking structure is converted to an ADU, the local agency cannot require those off-street spaces to be replaced.
Can I make my garage bigger when I convert it?
An ADU within an existing accessory structure may include an expansion of up to 150 square feet for ingress and egress under Gov. Code 66323(a)(1). Larger additions are usually reviewed as a new or attached ADU under your city’s standards.
Can I convert an attached garage?
Yes, attached garages can often be converted. Because the space shares a wall with the main house, fire separation and the connection between the two spaces need extra attention.
How long does the city have to review my application?
State law requires the city to approve or deny a complete ADU permit application within 60 days. Plan check corrections and incomplete applications can add time.
