Quick Answer: What Changed for ADUs in 2026

  • JADU owner-occupancy is narrower (AB 1154). An owner only has to live on the property when the junior ADU shares a bathroom with the main house.
  • No short-term rentals for JADUs (AB 1154). A JADU that is rented must be rented for more than 30 days.
  • Size is measured as interior livable space (SB 543). This clarifies how square footage limits are applied.
  • Faster completeness check (SB 543). Cities must tell you within 15 business days whether your ADU application is complete, and they must offer a written appeal process.
  • City ADU ordinances must be sent to the state (SB 9). A local ADU ordinance not submitted to the California Department of Housing and Community Development (HCD) within 60 days of adoption is null and void.

The New ADU Laws in More Detail

AB 1154: Junior ADUs (JADUs)

A junior ADU is a unit of up to 500 square feet created inside the existing home. Under AB 1154, the owner-occupancy requirement now applies only when the JADU shares sanitation facilities (a bathroom) with the main house. If the JADU has its own bathroom, the owner does not have to live on site. The same law bars JADUs from being used as short-term rentals: rentals must be longer than 30 days.

What it means for you: If you plan to rent a JADU and you do not live on the property, give it its own bathroom. If you were hoping to list it on a nightly-rental site, plan for longer-term tenants instead.

SB 543: Measurement, Fees and Review Deadlines

SB 543 makes several practical changes:

  • ADU size limits refer to interior livable space.
  • It adjusts how impact-fee exemptions are applied.
  • It allows different ADU types to be combined on one property, following the state’s rules.
  • Local agencies must decide within 15 business days whether an ADU application is complete.
  • Cities must provide a written appeal process for ADU applications.

What it means for you: A complete, well-organized application moves faster, and you have a clearer path if you disagree with a decision.

SB 9 (2025): Local ADU Ordinances

If a city adopts or changes its ADU ordinance, it must submit it to HCD within 60 days. If it does not, the ordinance is null and void. This helps keep local rules in line with state law.

AB 462: Coastal Permits

AB 462 speeds up coastal development permits for ADUs and took effect in October 2025. It mainly affects properties in the coastal zone, not most homes in Anaheim, Garden Grove, Westminster, Fountain Valley or Santa Ana.

Rules That Still Apply in 2026

The new laws build on existing state ADU law. In general:

Permit decisions within 60 days

Once an ADU application is complete, the local agency generally must approve or deny it within 60 days.

Setbacks of 4 feet

Cities generally cannot require more than 4-foot side and rear setbacks for ADUs covered by state rules.

Height

A detached ADU is generally allowed up to 16 feet, with more height allowed in certain cases (for example near major transit).

Impact fees

ADUs of 750 square feet or less are exempt from impact fees; larger ADUs may be charged fees proportional to their size.

No owner-occupancy for standard ADUs

Owner-occupancy cannot be required for a standard ADU.

More than one unit

Many single-family lots can have an ADU and a JADU, depending on the property and the type of unit.

Every property is different. Lot size, utilities, easements, existing structures and your city’s own ordinance all affect what you can build.

What This Means in Orange County Cities

State law sets the baseline, but each city handles the details: plan review, fees, utility requirements and inspections. Some cities offer extra help. The City of Anaheim, for example, runs an ADU Express Process and a free pre-approved plan catalogue with four designs, from a 224 sq ft studio to a 1,199 sq ft three-bedroom unit.

If your home is in Garden Grove, Westminster, Fountain Valley or Santa Ana, check that city’s planning and building pages or call the planning counter before you pay for design.

Checklist Before You Start ADU Design

Decide the goal

Family space, rental income or flexibility for later.

Choose the type

Detached ADU, attached ADU, garage conversion or JADU.

Check utilities

Electrical panel capacity, water, sewer and gas often decide cost and schedule.

Look at access and setbacks

How will workers, materials and future tenants reach the unit?

Plan the bathroom question

For a JADU, a separate bathroom changes the owner-occupancy rule.

Get a site visit

Existing conditions often change the scope. A reliable price needs a site review and a written scope.
